1. Nature of the Platform
1.1 Saka is a marketplace and logistics facilitator. Saka is not the manufacturer, seller, or owner of any item a Customer requests, and Shoppers are independent contractors, not Saka employees or agents, except where a Shopper is fulfilling a listing Saka has reviewed and approved (Section 5).
1.2 Unlike a pure classifieds or lead-generation marketplace, Saka takes an active role in each order: Saka's team reviews scouting reports and selects a quote, processes payment, receives items at its own warehouse, and arranges onward delivery. Sections 8 to 10 set out what Saka is and is not responsible for at each stage.
2. Acceptance and changes to these Terms
2.1 Your access to and use of the Platform is subject to these Terms and any other rules Saka publishes in the app from time to time.
2.2 Saka may amend these Terms at any time. Material changes will be flagged in the app before they take effect; continuing to use Saka after a change takes effect means you accept the updated Terms.
3. Eligibility and accounts
3.1 You must be at least 18 years old and able to form a binding contract to use Saka.
3.2 You must provide accurate information when registering and keep it up to date, keep your password secure, and tell us immediately at support@saka.global if you suspect unauthorised access to your account. You may register only one account, and you are responsible for everything that happens under it. Saka may refuse, suspend, or close an account at its discretion, including for the reasons in Section 14.
3.3 Shoppers additionally go through a verification step before they can accept jobs: submitting a government ID (national ID or passport) and address details, which Saka's team reviews before approving the application. A Shopper's chosen shopping country is locked once approved.
4. Custom requests and scouting
4.1 When a Customer submits a custom request, it is made visible to Shoppers based in the requested source country. More than one Shopper may accept the same request and go scout it independently, visiting stores, checking real prices and availability, and reporting back with a photo and cost. This does not create any obligation for Saka to pay a Shopper who scouts but is not selected; see Section 9 on how Shoppers are paid.
4.2 Saka's team reviews the submitted reports and selects one to quote to the Customer, generally the most competitive genuine report, together with Saka's shipping, duty, service, and (where applicable) collection fees. The Customer then chooses to accept or decline that quote. Accepting a quote creates a binding purchase; declining ends that specific request unless the Customer asks Saka to send it to another Shopper.
4.3 A quote is Saka's best estimate at the time it is sent and can expire; Saka will let you know if a quote needs to be re-priced because it expired or conditions abroad changed materially before payment.
5. Pickup/delivery requests and Shopper listings
5.1 For a pickup and delivery request, the Customer describes an item they already have arranged to buy or own abroad, and Saka's team prices the collection, shipping, and any handling required before broadcasting it to Shoppers in that market to collect and ship home. The Customer can pay once Saka has priced the job, before a Shopper has necessarily been assigned.
5.2 Shoppers may also list items they already have available to sell directly, subject to Saka's review and approval before a listing goes live. Buying a listed item creates an order in the same way as an accepted custom request, priced at the listing's stated amount plus shipping.
6. Payments
6.1 All payments for anything ordered through Saka must be made inside the Platform, through Saka's payment processor. Saka currently settles payments in Kenyan Shillings (KES), including via M-Pesa.
6.2 Asking for, offering, or accepting payment outside the Platform for a Saka order is a breach of these Terms and is not covered by any Saka protection, refund process, or dispute handling. Saka has no way to verify or reverse a payment it never processed. If anyone asks you to pay outside the Platform, tell Saka in the app.
6.3 Prices shown to a Customer break down into the item cost, Saka's shipping and duty estimate, a service fee, and, where relevant, a collection fee for items that need consolidating before they can ship. These are estimates based on the best information available at quoting time; see Section 10 on customs and duty.
7. Cancellations and refunds
7.1 A Customer can cancel a request before it has been priced and paid for at no cost. Once a quote has been accepted and paid, cancelling may not be possible if the Shopper has already purchased the item; Saka will tell you where an order stands before you pay.
7.2 If Saka or a Shopper cancels an order after payment (for example, an item turns out to be unavailable), Saka will refund the amount paid to the original payment method or to the Mpesa/mobile money number on file, within a reasonable time.
7.3 Because items are sourced specifically per request, Saka does not offer a general change-of-mind refund once a Shopper has purchased an item on a Customer's behalf, except where the item received does not match what was quoted and reported.
8. Customs, duty, and prohibited items
8.1 The Customer is responsible for making sure a requested item is legal to import into Kenya. Saka may decline to source or ship an item it reasonably believes is illegal, counterfeit, hazardous, or restricted.
8.2 Saka's duty and shipping estimate is based on its best information at the time of quoting; actual customs duty determined by Kenyan authorities can differ, and Saka is not liable for a difference between an estimate and the duty actually assessed, though it will inform the Customer as soon as it becomes aware of a material change.
9. How Shoppers are paid
9.1 A Shopper who scouts a custom request is not guaranteed payment for the scouting itself; payment is generated only if their report is the one Saka selects and the Customer completes payment, or for pickup/delivery and listing orders once the job is completed.
9.2 Payouts are released once Saka has confirmed receipt of the item at its warehouse, using the payout method (M-Pesa, bank transfer, PayPal, or Wise) the Shopper registered with. Shoppers are responsible for any tax obligations arising from their earnings on Saka in their own country of residence.
10. Delivery, delays, loss, and damage
10.1 Saka aims to move items from purchase to delivery in Nairobi within the timeframes shown in the app, but timelines are estimates, not guarantees, since they depend on international shipping, customs clearance, and factors outside Saka's control.
10.2 Saka carries appropriate care for items once they reach its warehouse. Where an item is lost or damaged while in Saka's custody (after warehouse receipt and before delivery), Saka will investigate and, where Saka is at fault, refund or replace the item at Saka's discretion. Saka is not responsible for damage that occurred before an item reached its warehouse, or for delays caused by customs authorities, carriers, or events outside Saka's reasonable control.
10.3 The Customer must confirm delivery in the app once an item arrives; confirming closes the order and starts the review window. If something is materially wrong with what arrived, contact Saka before confirming.
11. Content you submit
11.1 You keep ownership of photos, descriptions, messages, and any other content you submit, post, or upload to Saka ("User Content"), such as reference photos, scouting price photos, receipts, listing photos, and reviews.
11.2 By submitting User Content, you grant Saka a non-exclusive, worldwide, royalty-free licence to host, store, display, and reproduce it for the purposes of operating the Platform. That includes, for example, showing a listing photo to Customers, or a receipt photo to the relevant Customer and Saka's team, and, where you separately agree, using it in Saka's own marketing. You confirm you have the right to submit the content and that it does not infringe anyone else's rights.
11.3 Saka may remove User Content that breaches these Terms, infringes a third party's rights, or that Saka reasonably believes is unlawful, false, or harmful.
12. Reviews and conduct
12.1 Customers may rate and review a Shopper after an order is confirmed delivered. Reviews must be honest and about the actual order; Saka can remove a review that is abusive, unrelated, or fraudulent.
12.2 Messaging between Customers and Shoppers must stay civil and on-topic; harassment, discrimination, or repeated attempts to move a transaction off-platform can lead to account suspension.
13. Compliance and sanctions
13.1 You represent that you comply with the laws applicable to you in using Saka, and that you are not, and are not owned or controlled by, any person or entity subject to trade sanctions or on a government sanctions or watch list in Kenya, the country you are accessing Saka from, or any country whose sanctions regime applies to the transaction.
13.2 You will not use Saka to launder money, finance illegal activity, or move funds for anyone other than yourself. Saka may refuse a transaction or close an account where it reasonably suspects either.
14. Suspension and termination
14.1 Saka may suspend or close an account that breaches these Terms, provides false information, attempts to pay or be paid outside the Platform, engages in fraud, or poses a risk to other users or to Saka. Where reasonably possible, Saka will explain why.
14.2 You may close your own account at any time by contacting support@saka.global; outstanding orders and payouts are settled first.
15. Disclaimers and limitation of liability
15.1 The Platform is provided "as is." To the fullest extent permitted by Kenyan law, Saka disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement regarding items sourced through the Platform, since Saka does not manufacture or inspect items beyond what a Shopper reports and photographs.
15.2 Saka's total liability for any claim arising from an order is limited to the amount the Customer paid for that order, except where Kenyan law does not allow such a limit (for example, liability for fraud or wilful misconduct).
16. Indemnity
16.1 You agree to indemnify Saka against claims, losses, or costs arising from your breach of these Terms, misuse of the Platform, or, for a Shopper, misrepresenting an item's condition, price, or availability, or shipping a prohibited item.
17. Force majeure
17.1 Saka is not liable for any failure or delay in providing the Platform or fulfilling an order caused by events outside its reasonable control, including customs or border delays, carrier disruption, natural disasters, war, civil unrest, labour disputes, government action, or failures of third-party systems Saka relies on, including its payment processor or hosting provider.
18. Governing law and disputes
18.1 These Terms are governed by the laws of Kenya. Any dispute that cannot be resolved directly with Saka's support team will be subject to the exclusive jurisdiction of the courts of Kenya, without prejudice to any statutory right to alternative dispute resolution.
19. General provisions
19.1 Notice. Saka may give you notice through the app or to the email or phone number on your account. You can give notice to Saka at support@saka.global.
19.2 Assignment. You may not transfer your account or your rights under these Terms to anyone else. Saka may assign these Terms, in whole or in part, to an affiliate or to a successor of its business.
19.3 Severability. If any part of these Terms is found unenforceable, the rest remains in effect, and the unenforceable part will be replaced with one that achieves its intent as closely as the law allows.
19.4 Entire agreement. These Terms, together with the Privacy Policy, are the whole agreement between you and Saka about the Platform, and replace any earlier agreement on the same subject.
19.5 No waiver. Saka not acting on a breach of these Terms is not a waiver of its right to act on that or a later breach.
